The "Instrument Hunt" Contest

1. CONTEST DURATION

The “Instrument Hunt” Contest (the “Contest”) will take place in Quebec from August 16, 2024 at 5:00:00 p.m. ET until August 18, 2024 at 4:00:00 p.m. ET (the “Contest Period”).

 

2. ELIGIBILITY

This Contest is open to any person who:

(i) is a resident of Quebec;

(ii) is 18 years of age at the time of the contest;

(iii) collect the eight QR codes associated with a musical instrument on site of the Virée classique between August 16, 17, or 18, 2024 and complete the registration form via the link provided once the collection is completed.

Excluded are employees of the Orchestre symphonique de Montréal, as well as employees of any organization or company collaborating on the Virée classique, representatives or agents, advertising and promotional agents, and all persons with whom they are domiciled (hereinafter the “Partners”).

 

3. HOW TO ENTER

To participate, you must collect the eight QR codes associated with a musical instrument on site of la Virée classique, to access and complete the registration form. No purchase necessary. A limit of one (1) entry per participant per day will be accepted. Odds of winning depend on the number of eligible entries registered and received at the time of the draw.

 

4. PRIZES

There will be three (3) prizes awarded. Each winner will receive the following price:

One (1) pair of tickets to one of the OSM concerts selected from the 2024-2025 season. The winner will need to contact OSM Customer service to choose the concert.

Non-transferable and non-refundable.

This prize has an approximate value of $290.

A drawing will take place at the OSM offices on Tuesday, August 20, 2024, at 12 p.m. The prize must be claimed by September 10, 2024, at 12 p.m. After this date, we cannot guarantee concert availability.

 

5. AWARD OF PRIZES

5.1 In order to be declared a winner, the selected entrant must, in addition to meeting the Contest eligibility criteria and complying with the Official Contest Rules (the “Winner”):

1. a) respond to the e-mail message left by the OSM employee within two (2) business days following the selection of his/her entry;
2. b) sign a standard declaration and release form prior to receiving the prize, releasing the contest organizers from all liability for any damages that may result from the use of the prize. The winner must provide this document within two (2) days of it being sent.

5.2 Disqualification.

Failure to comply with each of the conditions set forth in the above paragraph will result in the selected entrant being disqualified and ineligible to receive any prize. In such a case, OSM employees reserve the right, at their sole discretion, to disqualify the selected entrant.

 

5.3 Prize pick-up.

Upon receipt of the Declaration and Release of Liability Form signed by the selected entrant, the OSM representative will contact the winner to inform him or her of the procedure for collecting the prize.

 

6. GENERAL TERMS AND CONDITIONS

6.1 Verification of entries

The validity of all entries is subject to verification by OSM employees. Any entry that is illegible, incomplete or fraudulent will be disqualified. Any entrant or person attempting to enter by any means which is contrary to these Official Contest Rules or which is otherwise disruptive to the operation of this Contest or which is likely to be unfair to other entrants or potential entrants will be disqualified. All decisions of the contest judges, who may be employees, including without limitation any question of eligibility or disqualification of any entry or participation, are final. Entries become the property of the employees and none will be returned.

6.2 Contest rules and regulations are available upon request from the OSM offices in Montreal.

6.3 Acceptance of prize.

The prize must be accepted as described in these rules and regulations and may not be returned or substituted for another prize, nor exchanged in whole or in part for cash, subject only to the provisions of the paragraph below. This prize is not transferable to any other person.

 

6.4 Prize substitution

OSM employees reserve the right, at their sole and absolute discretion, and for any reason whatsoever, to substitute a prize or a portion thereof with a prize of equivalent or greater value, including the cash value of the prize.

6.5 Agreement

The winner agrees to abide by the contest eligibility criteria and these rules. Participation in the contest attests to having received and understood these rules.

6.6 Prizes/Winners.

By participating in this Contest, each entrant acknowledges that employees and partners will not be required, under any circumstances, to award more prizes than the number of prizes available, as set out in the official Contest rules. In the event that, for any reason whatsoever (including but not limited to any error, malfunction or defect in the design, promotion, management, implementation or administration of the Contest, whether mechanical, electronic, human or otherwise), the number of declared winners or the number of prizes claimed by entrants exceeds the number of prizes available, the employees and partners reserve the right, at their sole and absolute discretion, to terminate the contest in whole or in part, without prior notice, subject only to the prior approval of the Régie des alcools, des courses et des jeux du Québec, if required, in the province of Québec, and to award the prize to the winner.

 

6.7 Employees and partners assume no liability whatsoever in the event that their inability to act is the result of an event or situation beyond their control or of a strike, lockout or other labour dispute in their establishments or in the establishments of organizations or companies whose services are used to hold this contest. They reserve the right, in their sole and absolute discretion, to modify, cancel, terminate or suspend the Contest in whole or in part, for any reason or circumstance, including, without limitation, should an event beyond their control corrupt or affect the administration, security, impartiality or normal operation of the Contest, such as a virus, computer bug or unauthorized human intervention, subject to the approval of the Régie des alcools, des courses et des jeux du Québec in the province of Quebec.

6.8 By entering this contest, the winner authorizes employees and partners to broadcast, publish and otherwise use the winner’s name, photograph, image, statement relating to the contest or any prize, place of residence and/or voice for publicity purposes, without any form of compensation.

 

6. 9 By entering or attempting to enter this Contest, each entrant and/or purported entrant agrees to release, discharge and forever hold harmless the Partners and their directors, officers, employees, shareholders, agents or other representatives (collectively, the “Indemnitees”) from any and all claims, actions, damages, claim, demand, cause of action, suit, debt, duty, account, bond, agreement, warranty, indemnity, contract or liability of any kind whatsoever arising out of or in connection with entrant’s participation or attempted participation in the Contest, compliance or non-compliance with these Contest Rules or acceptance and use of the Prize. The Indemnitees will not be liable for lost, incomplete, late or misdirected entries or for any failure of the Contest Website during the Contest Period, or for any technical malfunction or other problems with any telephone network or lines, computer online systems, servers, access providers, equipment or software or for any other technical problems or traffic congestion on the Internet or at any website, or any combination of the foregoing, and will not be liable for any injury or damage to any person or property resulting from or related to such person’s or property’s participation or attempted participation in the Contest. Any attempt to deliberately damage any website or undermine the legitimate operation of this Contest is a violation of criminal and civil laws and, should such an attempt be made, the Partners reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

6.10 No communication or correspondence related to the Contest will be exchanged with entrants, except with the entrant selected as the potential prize winner.

6.11 Personal information. Personal information collected from entrants in connection with this Contest is used solely for the administration of this Contest or as permitted by law and is subject to the OSM Privacy Policy at https://www.osm.ca/fr/politique-de-confidentialite/. No communication, commercial or otherwise, unrelated to this contest, will be sent to the participant by the partners, except as permitted by law.
